But I was also struck by the chairman of the Senate Judiciary Committee being so brazen about the politicization of the nation’s federal courts. To hear Graham tell it, judges should effectively see themselves as political operatives who should prioritize a broader ideological agenda.

Or put another way, the chairman of the Senate Judiciary Committee seems to scoff at the idea of an independent judiciary.

That said, the senator isn’t wrong about the likely consequences of his partisan efforts: Trump’s re-election would very likely “change the judiciary for several generations.” It would be a development that would shape American public life for much of the 21st century — on everything from the environment to health care, civil rights to the economy — and if progressive-minded voters don’t share Lindsey Graham’s interest in this, they will regret it.

EPA suspends enforcement of environmental laws amid coronavirus

The Environmental Protection Agency (EPA) issued a sweeping suspension of its enforcement of environmental laws Thursday, telling companies they would not need to meet environmental standards during the coronavirus outbreak.

The temporary policy, for which the EPA has set no end date, would allow any number of industries to skirt environmental laws, with the agency saying it will not “seek penalties for noncompliance with routine monitoring and reporting obligations.”

“EPA is committed to protecting human health and the environment, but recognizes challenges resulting from efforts to protect workers and the public from COVID-19 may directly impact the ability of regulated facilities to meet all federal regulatory requirements,” EPA Administrator Andrew Wheeler said in a statement.

“Incredibly, the EPA statement does not even reserve EPA’s right to act in the event of an imminent threat to public health,” Giles said.

“Instead, EPA says it will defer to states, and ‘work with the facility’ to minimize or prevent the threat. EPA should never relinquish its right and its obligation to act immediately and decisively when there is threat to public health, no matter what the reason is. I am not aware of any instance when EPA ever relinquished this fundamental authority as it does in this memo.

The diminished compliance requirements for industry comes at a time when the EPA has refused to budge on deadlines for comments as they proceed with a number of deregulatory actions.

Environmental and public health groups had argued that those with science and health backgrounds who would normally weigh in on such regulations have been pulled into the coronavirus fight, leaving them unable to divert their attention.

“The Environmental Protection Agency has not shown the same concern for the impact the coronavirus has had on the ability of community and public interest groups to respond to various proposals to weaken environmental standards,” Schaeffer wrote in the letter.

But the EPA has argued exceptions were not needed.

Backlog of toxic Superfund clean-ups grows under Trump

WASHINGTON (AP) — The Trump administration has built up the biggest backlog of unfunded toxic Superfund clean-up projects in at least 15 years, nearly triple the number that were stalled for lack of money in the Obama era, according to 2019 figures quietly released by the Environmental Protection Agency over the winter holidays.

The accumulation of Superfund projects that are ready to go except for money comes as the Trump administration routinely proposes funding cuts for Superfund and for the EPA in general. The four-decade-old Superfund program is meant to tackle some of the most heavily contaminated sites in the U.S. and Trump has declared it a priority even while seeking to shrink its budget.

The unfunded projects are in 17 states and Puerto Rico. They range from abandoned mines that discharged heavy metals and arsenic in the West to an old wood pulp site in Mississippi and a defunct dry cleaner that released toxic solvents in North Carolina.

But two former EPA officials whose work dealt with Superfund oversight said the growing backlog of stalled Superfund projects under the Trump administration, and steady or ebbing numbers of clean-up construction projects completed, point to a different picture.

“They’re misleading Congress and the public about the funds that are needed to really protect the public from exposure to the toxic chemicals,” said Elizabeth Southerland, who worked for 30 years at EPA, including as director of science and technology in the water office, before retiring in 2017. ’’It’s detrimental.”

But overall, the backlog of 34 unfunded projects is up from only 12 in 2016, Obama’s last year.

At the site of another of 2019′s unfunded Superfund projects, Montana’s Upper Tenmile mining region, which includes the community of Rimini and a subdivision downstream, the EPA has been providing bottled water to residents for the past decade in response to water supplies polluted by about 150 abandoned gold, lead and copper mines.

Pollution still flows from the mines and into Upper Tenmile Creek more than 20 years after the area was added to the Superfund list.

The Guardian reported that reduced groundwater levels threaten four species of fish in the region: the Yaqui topminnow; chub; beautiful shiner; and Yaqui catfish. The federally protected Chiricahua leopard frogs, Huachuca water umbel, Mexican garter snakes and Aplomado falcon are also under threat.

“There’s good reason to believe that the Yaqui fish’s only U.S. habitat is drying up as a result of tens or hundreds of thousands of gallons of groundwater being pumped to build the border wall,” Laiken Jordahl, a borderlands campaigner with the Center for Biological Diversity, told the newspaper.

The Center for Biological Diversity said Trump has waived dozens of environmental and public health laws to speed up the construction of his border wall through wildlife refuges, national monuments and other protected landscapes.

The Trump administration suspended 28 federal laws that protect clean air, clean water, public lands and endangered wildlife in October, including the 1969 National Environmental Policy Act, the Endangered Species Act, National Fish and Wildlife Act and Migratory Bird Conservation Act.

A 2017 study by the Center for Biological Diversity found the construction of the wall along the entirety of the nearly 2,000-mile long border between the U.S. and Mexico would have a “disastrous” impact on 93 endangered or threatened species, including jaguars, Mexican gray wolves and Quino checkerspot butterflies.

The study said a wall would block the movement of many species and could lead to the extinction of the jaguar, ocelot, cactus ferruginous pygmy owl and other species.
