Last week, the Supreme Court chose not to take up a case brought to them by former Rowan County (Kentucky) Clerk Kim Davis, the anti-gay government official who wouldn’t issue same-sex marriage licenses even though that was her job. But that wasn’t the big news.
The headlines focused on how two justices, Clarence Thomas and Samuel Alito, issued a statement saying that, while they agreed it was the right move not to hear this particular case, they believed the Obergefell ruling that legalized marriage equality nationwide needed to be overturned.
That was especially disturbing because Chief Justice John Roberts dissented in Obergefell, two new justices have been appointed to the court by Donald Trump, and another vehemently anti-LGBTQ judge will likely join them within weeks. There’s a very strong chance that, like abortion rights, marriage equality will soon be overturned.
Because this is obviously a matter centered around religion and “religious freedom” (i.e. faith-based bigotry), the leaders of the Congressional Freethought Caucus have issued a statement denouncing that possibility.
Representatives Jared Huffman and Jamie Raskin sent this along in an email:
Suggesting reversal of this landmark ruling is a dramatic attack on the LGBTQ+ community that turns religious liberty into a weapon against other people’s fundamental rights. Religious freedom isn’t the right to compel the government to deny the equal rights of other citizens. But, as members of the Congressional Freethought Caucus, we see right-wing forces on the Court and in Congress trying to twist religious free exercise into a bizarre new right to make the state discriminate against disfavored groups.
Any government that can turn the clock back to discriminate against same-sex couples can also turn it back to discriminate against interracial and interfaith couples. Nothing could be more deeply at odds with our principles of constitutional freedom and equality for all Americans.
That right there is alarming. The congressmen are saying that if marriage equality can be overturned, there’s really nothing that could prevent Christians from making the same argument in other ways.
What happens if a county clerk refuses to issue a marriage license to an interracial couple using the same justification as Kim Davis? What happens if a baker refuses to sell a wedding cake to an interfaith couple? If religion becomes a legal excuse to avoid following the law, it would be a disaster.
This is not a slippery slope fallacy. While fewer Christians have a problem with interracial/interfaith couples, those bigots exist. It’s up to our courts — and our legislators — to make sure bigotry has no place in the public square. With a conservative supermajority on the Supreme Court, that protection could be out the window.
What the hell is wrong with our country, really any adult who thinks this is normal or OK is in need of mental health treatments themselves. Hugs
Via email from hate group leader Brian Brown:
Conservatives Neil Gorsuch and Brett Kavanaugh both strongly believe that the constitution should be interpreted as written and, thus, should be reliable votes against the imposition of same-sex marriage. Chief Justice John Roberts strongly objected to the majority ruling in Obergefell. And Judge Amy Coney Barrett has a long record of personal support for traditional marriage and has been sharply critical of Supreme Court rulings that articulate so-called “rights” that are found nowhere in the text of the Constitution.
It takes five justices on the Supreme Court to form a majority. So how does the speculation look now on reversing Obergefell? Thomas + Alito + Gorsuch + Kavanaugh = 4. Barrett would = 5, a majority. Chief Justice Roberts can be fickle so we can’t count on him being the deciding vote. But with Amy Coney Barrett on the Supreme Court, her deciding vote to restore marriage could well be enough to persuade Roberts to stick with his original opinion and overturn Obergefell as well.
You can see how critical it is that Judge Amy Coney Barrett be confirmed to the Supreme Court. The next three weeks are crucial in that regard. That’s why we are asking every NOM supporter to make a financial contribution right away so that we can do everything in our power to help secure her confirmation. Every donation will be 100% matched up to a total match of $10,000. Please give generously.
For this guy, Brian Brown, I can not tell if he is a true believer or just a grifter realizing he can get uninformed or religiously indoctrinated people to send him lots of money over this issue. The reason I say this is because he has spent his adult career begging for money to stop same sex marriage and then to over turn it. Everything he puts out includes a beg for money. Unlike Scott Lively who really is a true believer hater of gays. I do not know if Lively was molested as a kid but he is venomous and wants gays killed. Brown just seems to want his nice large salary to continue even though he has failed at everything he has tried to promote. What do you think? Hugs
To these people somehow my marriage keeps them from worshiping their god. My right to equal status under secular laws for marriage benefits violates their religious freedom while they can still go to their churches, do their rituals, pray their prayers, preach their myths, wear their religious symbols, and force their doctrines on the rest of us on medical decisions. They are so filled with hate, with Christian privilege that not being able to deny me public services, to not be able to deny me equal rights under the laws, to not have the right to discriminate openly loudly, to not be able to oppress those they do not like is discrimination to them, and denying their rights. This was a secular country, but those who want it run by their religion have worked very hard over the last few decades to turn it into a theocracy. Ask yourself if any country that is a theocracy, that has forced religion with no dissent, ruled by the leaders of one sect of one religion is a country where the people have rights? Look at the islamic countries, just replace Islam with Christianity. Now replace Obergefell with Loving v. Virginia, is this still OK. If you replace same sex marriage with different race marriage is it still religious freedom to deny the right to that marriage? Or is it bigotry? Clarence Thomas wants to overturn Obergefell based on religious grounds, but his marriage to a white woman was opposed by major religious groups based on their religious freedom. Is his marriage going to be nullified to grant the bigots the right to deny him and his wife the right to marry. If you replace denying public services based on religious freedom rights against LGBTQ+ with the words black or jewish would it still be OK? What about those who claim it is their religious right not to let black people eat at the lunch counter or ride in the front of the bus? What is eating at me is how much these people have managed to do to chip away at women’s right, my rights, LGBTQ+ rights. Nothing matters to them but their right to force all of us to obey their church doctrines. Not the right to do them themselves their religious doctrines but the right to force the rest of us to live by them. Their church forbids them from eating ice cream so I can not eat ice cream either? Kim Davis was not asked to affirm the same sex marriage, not asked to go to the marriage, not asked to deny her god she was asked to do her job that she was paid to do for everyone one equally. She has several marriages and committed adultery, would it be OK for someone like her to deny her a marriage licence because her lifestyle is against their religious beliefs? If not, then it is not right to do so to same sex couples. Hugs
Via email from hate group leader Mat Staver:
Although the U.S. Supreme Court has declined to grant review of the Sixth Circuit Court of Appeals decision involving former Rowan County Clerk Kim Davis and regarding the legal doctrine known as qualified immunity, Justices Thomas and Alito appear to invite future challenges to the 2015 Obergefell marriage case.
Justice Clarence Thomas (joined by Justice Samuel Alito) wrote that the Supreme Court’s majority decision in Obergefell v. Hodges caused a collision with religious liberty and the Court must fix it. Four justices, including Chief Justice John Roberts, strongly dissented in Obergefell. Justice Alito predicted the opinion would cause significant problems for religious freedom.
Davis has continued to argue that she is not liable for damages because she was entitled to a religious accommodation (which former Governor Bevin and the legislature granted), and that her actions did not violate clearly established rights.
In 2016, Kentucky unanimously passed legislation to provide religious liberty accommodation for Kim Davis and other Kentucky clerks.
There has been no final ruling on whether Davis is liable for damages. Depending on how the case finally concludes at the lower court, Liberty Counsel will then file a petition to present the opportunity for the Supreme Court to address Obergefell.
Liberty Counsel Founder and Chairman Mat Staver said, “Even though the High Court declined to take up qualified immunity, Justices Thomas and Alito are inviting future challenges regarding Obergefell and to fix the mess the Court created.”
tRump’s new SCOTUS nomination is a firm believer in a theocracy. She is a firm believer in ruling based on her religion, not secular laws. Like Clarence Thomas she doesn’t believe equal treatment under the law applies to everyone, and would gladly deny equality to women and LGBTQ+. I listened to a breakdown of her beliefs and legal writings yesterday. Remember she has only been a judge for three years. Only three years, and now going to be on the highest court in the land making rulings the rest of us must live by. This is what the goal of the religious fanatics have been for decades.

The tweet’s mention of “build a ‘Kingdom of God’ in the United States” is an allusion to comments Barrett made in a 2006 commencement address at the University of Notre Dame Law School where Barrett was a faculty member from 2002 until 2017. Barrett told the graduating class:
“I’m just going to identify one way in which I hope that you, as graduates of Notre Dame, will fulfill the promise of being a different kind of lawyer. And that is this: that you will always keep in mind that your legal career is but a means to an end, and as Father Jenkins told you this morning, that end is building the kingdom of God. You know the same law, are charged with maintaining the same ethical standards, and will be entering the same kinds of legal jobs as your peers across the country. But if you can keep in mind that your fundamental purpose in life is not to be a lawyer, but to know, love, and serve God, you truly will be a different kind of lawyer.”
https://factcheck.thedispatch.com/p/does-amy-coney-barrett-want-to-end
In four years tRump and McConnell have managed to fill the courts with people like her at all levels. The only check was the SCOTUS. Seems not for long. Hugs
Republican Senate candidate Lauren Witzke is continuing her outreach to white nationalists by promoting her campaign in a video interview with the white nationalist site VDare. The Delaware Republican Party has continued backing Witzke despite her appeals to far-right extremists.
Witzke is running for the U.S. Senate in Delaware against incumbent Democratic Sen. Chris Coons. As Media Matters and others have documented, Witzke has frequently interacted with white nationalists and anti-Semites during her campaign. She has also praised the violent neo-fascist Proud Boys for helping her campaign.
Additionally, Witzke is a supporter of QAnon, the violence-linked conspiracy theory that started on message boards and has been labeled a potential domestic terror threat by the FBI.
The Delaware Republican Party and Chair Jane Brady have been supporting her campaign. Brady told Delaware Public Media last month that Witzke has “shown great energy, she’s very bright, and she’s worked very hard. And she’s earned the support of the party.”
One of Witzke’s main policy plans is “a full 10-year moratorium on all immigration,” a proposal that is also supported by VDare, an anti-immigrant white nationalist site. The Southern Poverty Law Center states that VDare “regularly publishes articles by prominent white nationalists, race scientists and anti-Semites.”
During the nearly 26-minute interview, Witzke and Brimelow primarily talked about immigration. She also pushed false white nationalist tropes, including stating:
- “We are bringing in people from Third World countries. We are bringing in cartel members and we’re doing it 100% legally.”
- “People are so worried about being called, you know, labeled a ‘white supremacist’ when, you know, we are giving our country away to foreigners. They are dismantling our culture, they’re taking down our historical monuments. They’re voting against our interests.”
- “We see that in [Rep.] Ilhan Omar’s [D-MN] district, you know, a district of refugees, they elected, you know, a Third World dictator, is what they did. And now it looks like the Third World.”
Media Matters contacted the Delaware GOP and Brady for comment but did not receive a reply from them as of posting.
Shortly after contacting the state party and Brady, Media Matters received an email from Witzke stating: “America is tired of Communist media outlets like CNN and the rest absurdly smearing Americans who want to limit immigration — including African Americans, Cubans, and Jews — as white nationalists or somehow fringe. Protecting the rule of law and our southern border is as American as apple pie.”
The culture in the US is and always has been a culture of accepting immigrants and blending other cultures into the existing one. The melting pot. The problem now is the white supremacists are not worried about culture, they appropriate other cultures as the rest of us do, but they are worried about demographics shifts and their loss of majority. Hugs
QAnon/GOP Senate Nominee Lauren Witzke Does Video Interview With White Nationalist Group VDare
Read the full article. As previously reported, Witzke has an arrest record for meth and heroin possession and has claimed that she used to smuggle drugs for Mexican cartels. VDare takes their name from Virginia Dare, who is believed to have been the first white child born in what would become the United States.
I feel so loved. I have long wondered what happened in this man’s life that he hates gay people so much. Some have said he is just using it to grift, to get money from people. But I think it is more than that. He has gone to other countries to try to get laws enacted against gay people, he really does hate LGBTQ+ people.
Via email from hate group leader Brian Brown:
It is absolutely imperative that we mount an unprecedented effort to ensure that this justice is confirmed without delay.
I’m asking you to make a sacrificial financial gift to NOM right now so that we can immediately deploy a comprehensive pressure campaign aimed at holding Republican Senate votes to confirm President Trump’s pick to the Supreme Court.
This is a moment that could pay decades of dividends for all the issues we care about. We’ve never had a bigger opportunity to advance our cause. Will you be with us at this historic moment?
The left has gone absolutely berserk at the prospect of President Trump naming another justice to the Supreme Court. They are threatening the country with total chaos, including violence. Already they’ve gathered their allies with Antifa to harangue GOP Senators at home. They’ve threatened arson attacks on Congress.
This is the Supreme Court nomination that could finally bring us a reversal of Roe v Wade and usher in a pro-life majority on the Court. It could also pave the way for the restoration of marriage to our laws and scrapping the illegitimate, anti-constitutional imposition of same-sex ‘marriage’ on the nation.
It will mean that religious liberty will be restored to its rightful place as a foundational constitutional right, and that the fake “rights” that are constantly demanded by the left – including special rules for homosexuals and the so-called transgendered – will no longer see the light of day.
You can be certain that LGBT extremists will be doing everything in their power to block this confirmation. It’s imperative that we be on the front lines fighting for control of the Supreme Court by demanding that Republicans support President Trump’s nominee.
History is counting on us at this critical moment. I pray with all I have that you will help make this moment the point in time where the direction of our nation was forever changed back to the “one nation under God” that has been so blessed throughout our country’s existence.
Please donate generously. I pray that every NOM supporter will discuss with their spouse and family what financial sacrifice they can make to help ensure that we meet this momentous moment in time. It’s that important.
Pompeo is speaking on the invitation of FPPC president John Stemberger, who once famously said that it was “worth dying” to stop same-sex marriage. Earlier this month Gov. Ron DeSantis appointed one of Stemberger’s proteges to the Florida Supreme Court. His group is separate from the Florida Family Association, which is best known here for flying anti-gay banners over Disney World during the annual Gay Days events.
More at the link above. Worth dying to stop same sex marriage says the guy who it doesn’t effect at all and whose marriage no one threatens. White Christian Privilege on parade. Hugs
The Washington Post reports:
In unguarded moments with senior aides, President Trump has maintained that Black Americans have mainly themselves to blame in their struggle for equality, hindered more by lack of initiative than societal impediments, according to current and former U.S. officials.
After phone calls with Jewish lawmakers, Trump has muttered that Jews “are only in it for themselves” and “stick together” in an ethnic allegiance that exceeds other loyalties, officials said.
Trump’s private musings about Hispanics match the vitriol he has displayed in public, and his antipathy to Africa is so ingrained that when first lady Melania Trump planned a 2018 trip to that continent he railed that he “could never understand why she would want to go there.”
